测序专利之争又起!PacBio VS 牛津纳米孔

牛津纳米孔公司的专利诉讼案总是一个接着一个。在结束了与Illumina公司的专利案之后,牛津纳米孔又接到了PacBio公司的专利诉讼。PacBio声称牛津纳米孔的MinIon和PromethIon设备侵犯了其专利US No.9546400。


牛津纳米孔公司的专利诉讼案总是一个接着一个。去年年初,Illumina公司在一份声明中称牛津纳米孔的MinIon和 PromethIon设备侵犯了自己的专利。到了去年中旬,Illumina公司和牛津纳米孔的官司在庭外和解,牛津纳米孔同意不再出口或售卖包含氨基酸序列纳米孔的产品,并销毁目前库存的产品。

就在上周,牛津纳米孔又被起诉侵犯专利,这次的原告方为PacBio(太平洋生物科学公司)。PacBio在美国特拉华地方法院提出了此项诉讼,声称牛津纳米孔的MinIon和PromethIon设备侵犯了其专利US No.9546400。

PacBio声称,不仅是牛津纳米孔侵犯了该专利,在生产和销售过程中还导致用户也侵犯了该专利。此外PacBio还表示,牛津纳米孔的专利侵犯对PacBio的业务和财产带来了损害,他们要求牛津纳米孔永远停止侵权行为,并赔偿所带来的损失、诉讼费以及律师费。

对于此项诉讼,牛津纳米孔的首席执行官Gordon Sanghera发表声明,向客户保证他们的服务不会发生变化。Gordon Sanghera 说,“我们相信这是竞争对手引发的一场无聊诉讼,我向所有的客户保证,这次诉讼以及其他诉讼不会破坏到我们的商业行为。”

牛津纳米孔的MinIon是一款手持纳米孔测序商业设备,PromethIon是通量更高、能够满足即时需求的测序仪。MinION也是牛津纳米孔家公司的核心产品,市场价为1000美元/个,主要用于病原监测、宏基因组学、变异检测,基因测序。

其实在去年8月份,PacBio就曾对牛津纳米孔提起过诉讼,指控其侵犯了专利US No. 9404146——核酸测序的组合物和方法。这项专利于去年8月份发行,包括使用双核苷酸模板来提高精度的单分子测序方法。
